Trump Handed A HUGE Victory After Judge Admits Major Mistake:
Following a hearing on Friday, an appeals court decided to halt the dissolution of former President Donald Trump’s businesses, granting a stay. President Trump only gained a portion of the victory because the appeals court allowed the trial to go on, which started this week. Prosecutors had resisted the motion for a postponement, claiming defense lawyers were trying “to sow chaos” and disturbance. Following the break, the Trump Organization released a statement in which they described the judge’s decision to revoke the Trumps’ company certificates as “overzealous.”
“In clear violation of their fundamental constitutional rights and due process, Judge Engoron’s order erroneously sought to adjudicate the rights of non-party business entities that employ nearly 1,000 hardworking New Yorkers, have never been accused of any wrongdoing, and were never given their day in court.” The statement says, “We will not stop fighting for our amazing staff and our firm against this politically driven persecution.

In an attempt to put the ongoing trial on hold, President Trump’s attorneys filed a 1,154-page appeal of the civil fraud case against him on October 4 and 5.
“[New York] Supreme Court’s Sept. 26 and Oct. 5, 2023 decision impose unauthorized, undemanded, overbroad relief without proper factual or legal predicate, which will result in significant, irreparable harm,” states the reason for requesting a stay on the case.
Days before the trial started, President Trump had already attempted to postpone it, and his plea had been turned down.
President Trump will lose his entire real estate empire in a matter of days unless his appeal is granted, as per Justice Arthur Engoron’s decision on September 26th, which found him liable for fraud and ordered the dissolution of the Trump Organization and related LLCs. Attorneys further contend that hundreds of workers will be impacted.
“Supreme Court clearly does not comprehend the scope of the chaos its decision has wrought,” the filing reads, describing the summary judgment as a “miscarriage of justice.”
The judge’s ruling from October 5th mandates President Trump to notify the court before applying for any new business certificates, even if they are not located in New York, as his previous ones have already been annulled. Executive vice presidents of the Trump Organization and his sons, Eric and Donald Trump Jr., are subject to comparable sanctions.
Trump Tower, 40 Wall Street, the upstate family retreat Seven Springs, and private homes owned by Eric and Donald Trump Jr. are among the structures they risk losing.
Michael Cohen, the former attorney for President Trump, filed the lawsuit claiming that his boss had exaggerated Trump’s net worth. In September 2022, New York Attorney General Letitia James filed a civil lawsuit against the former president, alleging that he had deceived the state by inflating his net worth in order to obtain better terms from banks and insurers. James had previously stated during her campaign for the position that she would sue the president for fraud.

The most recent appeal notes that the prosecutors never requested the liquidation of the Trump Organization in their petition, arguing that the court “abused its discretion” and overreached its jurisdiction in imposing the sanctions. Rather, Ms. James had requested a five-year ban on President Trump and his sons taking executive corporate positions in the state, along with $250 million in penalties. The attorneys contend that she failed to mention the statute that would have allowed the judge to grant remedy in the form of a dissolution.
“The consequences of enforcing the MSJ Decision [summary judgment on Sept. 26] are dire, and once done, cannot be undone,” the attorneys wrote.
They pointed out that “innocent nonparties and employees who depend on the affected entities for their livelihoods” are being swept up in the “overbroad” ruling. The decision was without process, statutory authority, or trial, and “renders impossible the lawful operation of multiple businesses and threatens termination of hundreds of New York employees without any jurisdiction or due process.”
“These non-parties are impacted without finding of any wrongdoing on the part of businesses,” they wrote. “Perhaps worst of all, it seeks to impose the corporate death penalty with no statutory authority for such remedy.”
When lawyers questioned Justice Engoron about the decision’s implications for specific properties, such as Trump Tower or Eric Trump’s home, he acknowledged that he had no idea what the full range of effects might be.
However, the attorneys contend that the Sept. 26 ruling will be implemented soon and that the Oct. 5 decision of the judge did not answer any of the queries posed by the counsel. The lawyers contend that prior to the order on September 26, they were not given the chance to submit their case.

Karma Just Caught Up with Georgia DA Fani Willis
In a late-night court filing last week, a pro-Trump attorney and former federal prosecutor seriously accused Fulton County District Attorney Fani Willis of “prosecutorial misconduct.”
In a 21-page document, Sidney Powell, one of the few lawyers defending then-President Donald Trump who maintained that his victory in 2020 was rigged, contended that Willis’s “indictment represents troubling and unethical conduct by the prosecutors.”
According to The Messenger, the filing, which has over 200 pages of exhibits, also claimed that Willis’ office neglected to provide potentially exonerating material.
The Messenger reported: “Powell is charged with seven state felonies in the broad election-racketeering case that claims there was a plot to rig Georgia’s 2020 presidential election results.” She entered a not guilty plea.
Powell’s attorney, Brian Rafferty, indicated in the Thursday filing that all charges should be dropped and that the indictment “represents troubling and unethical conduct by the prosecutors.” Rafferty additionally stated that Powell was not connected in any kind to the events that occurred in Coffee County, Georgia, and asserted that prosecutors “failed to conduct an independent investigation” into allegations that voting systems were fraudulently hacked there, which are crucial to the indictment.

Along with Trump election lawyer Kenneth Chesebro, Powell is scheduled to go to trial starting Oct. 23 after the two requested expedited proceedings under Georgia’s Speedy Trial Act. A trial date for the other 17 defendants has not yet been scheduled.
Wednesday was the deadline for Powell and Chesebro to file pre-trial motions other than those dealing with the exclusion of testimony. In a separate filing Wednesday, Powell argued the indictment “fails in every regard” to specify the details of her alleged crime.
At a conference set for Friday morning in Atlanta, Fulton County Superior Court Judge Scott McAfee was anticipated to review pre-trial motions, the outlet added.
A renowned legal expert and a former prosecutor have both said that the indictment of the former president Trump in Georgia was needless and supported the Democratic Party’s allegations of a “pile on.”

Willis indicted Trump and eighteen other people in August on a total of forty-one felonies, according to a 98-page document. “So why is [the Atlanta indictment] in the greater good and why is it promoting public confidence in the fairness of this [process] to have one of those seven state prosecutors pile on with a charge of her own? I don’t think it serves any greater good,” he said.
The individual asserted that the indictment was politically biased, attributed to Willis:
“I disagree with the exercise of prosecutorial discretion by an elected county prosecutor, a partisan, with a D [for Democrat] next to her name. I think it makes Trump’s chances of being convicted and punished higher if that’s the only goal here. If that’s the only goal, all seven states: Michigan, New Mexico, and on down the line, should be charging him too but that would be ludicrous,” Honig said.

15 People Dead After Kids Brought Home Strange Object:
According to a village leader on Saturday, a group of children discovered an explosive device while playing, and they brought it home, which resulted in at least 15 deaths in the eastern Congo.
The incident happened on Friday night in the village of Kyangitsi, which is in the province of North Kivu’s Masisi region.

Hundreds of Birds Found Dead in US City for Alarming Reason:
For four decades, David Willard has diligently surveyed the premises of the lakefront exposition center in Chicago, meticulously documenting deceased avian specimens. A large wave of songbird southern migration was expected over Chicago on Wednesday night, according to avian specialist and retired University of Wisconsin-Madison wildlife ecology professor Stan Temple.

According to McCafferty, the center has been hosting an event all week, so while the building was occupied, the lights were on, and when it wasn’t, they were off. She admitted that she didn’t know when the window strikes happened or if the facility was inhabited at the time.
“It’s an odd building,” Willard said of the exhibition center. “When it was built, people weren’t thinking about bird safety. They still aren’t in most architecture. It’s right on the lakefront. There are many nights when it’s lit up. People are describing the whole night of migration as part of a once-in-a-lifetime thing … (but) this still is an unacceptable intrusion by humans and their architecture. Last week Judge Engoron issued an order to rescind Trump’s business licenses as punishment in Letitia James civil lawsuit. Engoron effectively ordered the dissolution of Trump Org.
“Engoron ordered that some of Trump’s business licenses be rescinded as punishment, making it difficult or impossible for them to do business in New York, and said he would continue to have an independent monitor oversee Trump Organization operations.” – AP reported last week.

Last week Trump said his civil rights were violated after Engoron issued the order: “My Civil rights have been violated, and some Appellate Court, whether federal or state, must reverse this horrible, un-American decision,” Trump said on Truth Social last week.
The Appellate Division stayed Engoron’s order on Friday.

Migrant deaths at southern border soar to new high under Biden:
EXCLUSIVE — Migrant deaths at the U.S.-Mexico border have reached a new all-time high, with more bodies recovered over the past nine months than any full year in recorded history.
Since the start of the federal government’s 2022 fiscal year last October, authorities have found 609 bodies on the U.S. side of the southern border, according to internal U.S. Customs and Border Protection data obtained by the Washington Examiner and confirmed by three federal law enforcement officials.
The 609 figure is already higher than the 566 record set in all of 2021, which was the previous highest level, according to data detailed in CBP documents shared internally last week. CBP oversees the Border Patrol, whose 19,500 agents work between the land ports of entry.
"It seems like a daily occurrence people are dying," a senior Border Patrol official said.
"The way it's going, we could hit 700 pretty soon," a second senior Border Patrol official said.
This year's current total is more than double the 300 bodies recovered in 2019 and 247 in 2020, publicly available government data show.
The new revelation underscores the human toll of the Biden administration's border crisis — with more people apprehended crossing into the United States illegally in recent months than any other time in the Border Patrol's centurylong existence.
"Any needless death at the US-Mexico border is tragic. It is time we fix our broken immigration system — but any reform efforts MUST begin with securing our borders," said Rep. Mayra Flores (R-TX), who won a special election in June in a highly competitive border district. "Just five days ago, Secretary Mayorkas said the border is 'secure,' to which I say this is not only intellectually dishonest but also an outright lie."

The American Civil Liberties Union of Texas said the Biden administration's choice to consider imposing Title 42, a pandemic public health policy that allows some migrants who illegally enter the country to be immediately turned back, has played a role in the rise in deaths.
"It is past time for this administration and Congress to abandon deadly border policies, including Title 42, which has made things worse," said Shaw Drake, policy counsel and staff attorney at the ACLU of Texas, in a statement. “U.S. border policy is designed to have deadly outcomes. So long as a deterrence only, punishment-based approach to border policy dominates and those seeking safety at our border are turned away, tragic deaths will continue to mount."
Homeland Security Secretary Alejandro Mayorkas has insisted for 18 months that the government is creating a better and safer immigration system to handle the never-before-seen volume of people coming across from Mexico. The number of illegal immigration attempts jumped the month after President Joe Biden moved into the White House in January 2021 in response to his relaxing immigration enforcement, as well as push factors, including severe economic decline across Latin America resulting from the pandemic.
But the number of people apprehended at the southern border under Biden, more than 3 million people in a year and a half, shows no sign of returning to normal, leaving the revolving door at the border as the new norm.
The South Texas area known as the Rio Grande Valley reported 173 bodies found, more than any other of the nine regions that the Border Patrol divides the 2,000-mile southern border by. The Del Rio region of Texas followed with 154 bodies; 72 in Tucson, Arizona; and 64 in Laredo, Texas.
"Our families and communities in the RGV are paying for the cost of this administration’s self-inflicted humanitarian and security crisis. I've heard firsthand horror stories on many occasions, and it breaks my heart that Washington, DC treats this like a political issue and not what it really is — life and death," Flores said in a statement to the Washington Examiner. "We need leadership, we need action, and we need it now."
The rise in deaths and larger border issues could spell additional problems for Democrats in the November

Immigrant advocacy group No More Deaths did not respond to requests for comment, but advocacy groups have said in the past that the increase in border wall under the Trump administration has forced migrants to cross in more remote areas. While some migrants cross the border and surrender to police, others do not want to get caught and try to avoid detection.
Ranchers and farmers who live and work on extremely remote and expansive plots of land often make the discoveries of recently or long-deceased migrants, as well as Border Patrol agents. Bodies are reported to local, state, or federal authorities, which are added to the federal government's total number. The number of bodies found does not take into account how many have died or been killed whose whereabouts are unknown.
CBP declined to fulfill a Washington Examiner request last week for the number of migrant deaths this year, stating that the data were not available because it had recently employed a new methodology for tracking it. However, the internal documents shared with the Washington Examiner by employees outside of the public affairs office show that border officials were presented with the latest numbers last week.
Additionally, CBP did not respond to a Freedom of Information Act request submitted last week or an additional request Monday for comment about why it claimed the data were unavailable.
Images of migrant deaths under former President Donald Trump stoked national outrage, in particular among Democrats, but the deaths since Biden took office have largely gone unreported.
The 2019 image of Salvadoran father Oscar Alberto Martinez Ramirez and his 23-month-old daughter, Valeria, lying drowned on the U.S. side of the Rio Grande illustrated the enormous risks many have taken to get to the U.S.

Days earlier, the bodies of a 20-year-old woman, two babies, and a toddler were found along the same river.
Many have met the same fate — dying after traveling for weeks by foot, bus, and train in hopes of escaping extreme poverty, violence, and lack of opportunity back home. In an incident that garnered international attention, 53 migrants died after being trapped inside a tractor-trailer that a human smuggler had abandoned on the side of the road in San Antonio on its way from the border city of Laredo. The 53 deaths were included in CBP's 609 deaths year to date.
While CBP did not provide official data for 2022, a spokesperson said its 2021 number was 151 deaths based on a new counting methodology that focuses on deaths that are "in-custody." This total includes deaths of people detained in CBP custody as well as additional deaths during CBP enforcement activities, including people who are found in medical distress and die during life-saving activities, according to CBP.
"Smuggling organizations are abandoning migrants in remote and dangerous areas, leading to a rise in the number of rescues but also tragically a rise in the number of deaths as we saw most recently in San Antonio," a CBP spokesperson wrote in an email. "The terrain along the border is extreme, the summer heat is severe, and the miles of desert migrants must hike after crossing the border in many areas are unforgiving. Despite these inherent dangers, smugglers continue to lie to migrants claiming the borders are open. The borders are not open, and people should not attempt to make the dangerous journey."
While known deaths have risen under Biden to unprecedented levels, so too has the number of noncitizens rescued by Border Patrol agents on the southern border. Rescues are up threefold from 2019, when Democrats said the southern border was facing a humanitarian and security crisis.
Between October 2021 and June, agents have rescued 16,897, compared to 4,920 in all of 2019, 5,071 in 2020, and 12,833 in 2021. More than 70% of all rescues in South Texas’s Rio Grande Valley area are for serious heat-related injuries. A man rescued in the valley earlier this month was airlifted to a nearby hospital and survived after being bitten by a snake.
