Trump Finds Smoking Gun That Destroys Case Against Him…
The radical social justice-obsessed Attorney General of New York state, Letitia James, has been exposed as a loser who has tried to scalp President Donald J. Trump numerous times and fallen on her face each time. This latest attempt by the crazed AJ may be no exception if Trump is right in his recent court filings.
Trump says he warned people, in official legal documents sent to investors, of the very things James is trying to convince the nation Trump was trying to hide- in her recent stab at getting Trump, claiming he showed fraudulent business practices.
James accused Trump of routinely lying about the value of his properties to secure hundreds of millions in bank loans and tax breaks; she wants a judge to order $250 million in penalties and to bar the Trump family from selling, buying, collecting rent, or borrowing money in New York.”
The outcome is by no means assured. Trump has several options on how to fight back against the highly politicized actions of the radical left AG.
“Donald Trump says a simple disclaimer gives him immunity from fraud. Could he have a point? Trump’s net-worth statements start with disclaimers that essentially warn lenders: Check my math,” Lauren Italiano reported for Business Insider.
Trump’s financial statements were unsealed last week as part of James’ fraud lawsuit him, which has all been laughedat in the court of public opinion, humiliating the disgraced James as nothing more than an obsessed social justice warrior.
Recently, Trump told Fox News host Sean Hannity that his financial disclaimers to investors- absolve him of responsibility, and the AG has “no case.”
Italiano reported on the details, adding:
“Donald Trump hunched forward in his gold-painted, spindle-backed chair under the chandeliers of Mar-a-Lago’s glittering grand ballroom and told Sean Hannity why New York’s attorney general, who’d sued him earlier that day, has “no case.”
“We have a disclaimer,”Trump told the Fox News host.
“Right on the front.And it basically says, you know, get your own people. You’re at your own risk … It may be way off.”

Trump was describing the disclaimer that fills the second and third pages of his annual proclamations of net-worth — the 20-page “Statements of Financial Condition” at the center of AG Letitia James’ massive lawsuit against the former president, his three oldest kids, and his real estate and golf resort empire.
James calls these statements “fraudulent,” and says each one is filled with wildly exaggerated math — implausible numbers that misled banks into lending Trump and the New York-incorporated Trump Organization hundreds of millions of dollars over the past decade.
But Trump told Hannity none of that would matter because each Statement of Financial Condition begins with a warning.
“Be careful,” Trump told Hannity, the disclaimers essentially say.
Even Business Insider experts claim that Trump may have a point in their reporting.
Trump told Hannity that he felt he had the ‘smoking gun’ that would clear him saying about the disclaimer, “Because it may not be accurate. It may be way off … get your own people. Use your own lawyers,” Trump added. “Don’t rely on us.”
“Former financial crimes prosecutor Armen Morian, who worked for the AGs office from 2006 to 2019 before founding Morian Law, believes Trump has a point.
Sure, the annual Statements of Financial Condition may be filled with real whoppers, including all those years — from 2012 through 2016 — when they tripled the actual square footage of Trump’s triplex atop Manhattan’s Trump Tower, adding as much as $200 million a year to the former president’s net worth,” Italiano reported.
But each year, the disclaimers put banks on notice to double check the numbers before relying on them in deciding how much to lend and at what rate of interest, Morian said.
Yahoo news consulted legal experts like Tristan Snell, the lead prosecutor on the AG office’s separate, successful investigation into Trump University and reported with more details about the defense:
A property’s worth is subjective, and Trump’s side will certainly argue this in trying to beat James’ lawsuit. But you can’t simultaneously low-ball (for a tax break) and high-ball (to impress lenders) values for the same property, as James is alleging Trump did for years, the former prosecutors said.
“They can’t both be true” at the same time, said McCallion. “And you don’t have to prove which one was true and which one was false” to show fraud.
You also can’t pull a valuation out of thin air.
“There’s subjective, and there’s complete fantasyland,” noted Snell.
Fantasyland, as in Trump’s objectively false 2015 claim that his Trump Tower triplex on Manhattan’s Fifth Avenue spanned 33,000 square feet. It was actually 11,000 square feet, a whopper of an exaggeration first reported by Forbes.
Tripling his square footage let Trump claim his triplex was worth $327 million in collateral for a bank loan.
It’s an “absurd” appraisal, James told reporters in unveiling the lawsuit, given that at the time, “only one apartment in New York City had ever sold for even $100 million.”
Morian countered, though, that it’s common real estate practice for businesses to seek out and to use very different valuations, depending on whether you’re trying to lower your taxes or impress a bank.
“So long as the valuation is based on some rationale, you are not required to use the same methodology” for every appraisal, Morian argued.
“The methodology could have been wrong. The methodology could have been optimistic. But that doesn’t make a fraudulent statement,” he said.
“You can’t say your 3-year-old daughter’s version of the Mona Lisa is worth the same as the Mona Lisa,” Morian explained. “That would be ridiculous. And you can’t say the Mona Lisa is worth $3. But basically, there’s a broad range of discretion for how you value assets.”

US Circuit judge denounces 'cancel culture,' vows not to hire Yale law clerks: 'Yale not only tolerates the cancellation of views — it actively practices it':
A federal appeals judge has decided to take action against so-called "cancel culture" by denying clerkships to those educated by a place he considers to be a major cancel culture supply line: Yale Law School.
Judge James C. Ho of the Fifth Circuit Court of Appeals, based in New Orleans, recently spoke to the Kentucky Chapters Conference of the Federalist Society and openly castigated the intolerant practices promulgated by Yale Law and its graduates.
"Yale not only tolerates the cancellation of views — it actively practices it," he said.
To illustrate his point, Ho cited several recent examples that have affected the legal community. Back in late January, a would-be Georgetown Law senior lecturer, Ilya Shapiro, was placed on administrative leave after he tweeted criticism of President Joe Biden for selecting a candidate for the U.S. Supreme Court based on the immutable characteristics of race and sex. Ketanji Brown Jackson, a black woman, was sworn in to the Court last week, but Shapiro ultimately resigned his position at Georgetown back in June because he said that he could not abide a "place that excludes dissenting voices." Shapiro did not work one official day on the job.
For more evidence of the intolerance propagated at Yale Law, Ho also pointed to an event held at Yale itself. Back in March, more than 100 Yale Law students loudly disrupted a free speech presentation headlined by Kristen Waggoner of the Alliance Defending Freedom and Monica Miller of the American Humanist Association. The activist students caused such a disturbance that nearby classes complained, and police had to escort the speakers safely out of the building and into a police vehicle after it was over.
"I don't want to cancel Yale," Ho insisted. "I want Yale to stop canceling people like me."
Even a Mother Jones writer agreed with the premise of Ho's new policy, if not with Ho's reasons. "The highest levels of the federal judiciary have for too long been dominated by graduates of the same handful of select law schools," wrote senior reporter Tim Murphy, "and it’d be a mistake to say we’re better for it." The Biden administration DOJ has been working overtime to try to prove former President Donald Trump has nefarious dealings and has broken laws. None of their efforts have resulted in any charges against the former president.
Biden’s FBI has been in the news for internal misdeeds including raiding the former president’s home, as well as charges being brought against an array of FBI agents.
But while the contrived partisan nonsense is taking up the time and talents of federal law enforcement, real threats are looming that need attention from the agency.
Now some real charges and some real danger to the country have surfaced, and the situation involves none other than an employee of the Biden administration who has been involved with actual dealings that would betray the United States.
FBI agents have made an arrest in a key espionage case that would have had major national security implications for the U.S.
Not just any employee, but an employee of the National Security Agency, or NSA.
NSA staffer Jareh Sebastian Dalke of Colorado Springs, Colo., made his first federal court appearance on charges he attempted to sell government secrets to an undercover FBI agent believed to be a foreign operative. Dalke is facing espionage-related charges for allegedly plotting to transmit National Defense Information to a Russian agent.
The Department of Justice said in a press release that Dalke, 30, who “served as an Information Systems Security Designer” for less than a month earlier this year, utilized an encrypted email account to transmit a number of classified documents to someone he believed was working on behalf of the Russian Foreign Intelligence Service.
“In actuality, that person was an undercover FBI agent. Dalke subsequently arranged to transfer additional classified information in his possession to the undercover FBI agent at a location in Denver, Colorado,” the DOJ said.
The NSA staffer was arrested last week when he went to meet up with his suspected Russian contact, allegedly to sell more information.
The DOJ press release further states:
According to the affidavit in support of the criminal complaint, Dalke began communicating on or about July 29, 2022, via encrypted email with an individual he believed to be associated with a foreign government. Dalke told that individual that he had taken highly sensitive information relating to foreign targeting of U.S. systems and information on U.S. cyber operations, among other topics.
Dalke represented to the undercover FBI agent that he was still employed by the U.S. government but said he was on a temporary assignment at a field location. Dalke requested compensation via a specific type of cryptocurrency in exchange for the information he possessed and stated that he was in financial need.
“To prove he had access to sensitive information, Dalke transmitted excerpts of three classified documents to the undercover FBI agent. Each excerpt contained classification markings. One excerpt was classified at the Secret level, and two excerpts were classified at the Top-Secret level. In return for this information, the FBI undercover agent provided the requested cryptocurrency to an address Dalke provided,” the press release continued.
“On or about Aug. 26, 2022, Dalke requested $85,000 in return for additional information in his possession. Dalke also told the FBI undercover agent that he would share additional information in the future, once he returned to the Washington, D.C., area. Although he was not employed by the NSA while communicating with the FBI, Dalke re-applied to the NSA in August 2022,” the DOJ said.
The former NSA staffer agreed to send more information via a secure connection established by the FBI at a public site in Denver. Dalke was arrested by the FBI at that location on Wednesday, the DOJ said.
According to court documents, Dalke allegedly told the undercover FBI agent that he “recently learned that my heritage ties back to your country, which is part of why I have come to you.”
He also allegedly stated that he wanted to sell the secrets because he “questioned our role in damage to the world in the past and by a mixture of curiosity for secrets and a desire to cause change,” the Conservative Brief wrote.
If convicted, Dalke could face the death penalty, the DOJ said.
“Dalke is charged by criminal complaint alleging three violations of the Espionage Act, which makes it a crime to transmit or attempt to transmit NDI to a representative of a foreign nation with intent or reason to believe that information could be used to the injury of the United States or to the advantage of a foreign nation,” the press release noted. “The Espionage Act carries a potential sentence of death or any term of years up to life.”
The Espionage Act of 1917 was enacted shortly after the United States entered World War II. Originally under Title 50 of the U.S, Code, it has been amended numerous times and now can be found under Title 18.
