One of my key desires as a Chaplain is to help the one third of homeless people (those who for one reason or another would if "given a hand up, as opposed to a hand out") have touched my Godly heart to help somehow!
The attached video - minutes 15:00 to 20:00 answers an aspect of the above in a way that had not yet occurred to me - I knew that 2 thirds of Homelessness total was wrong, except for the one third I just mentioned above, but had no clue of the video`s clarification of "enslavement."

Federal appeals court lets DOJ assault case against Rep. LaMonica McIver move forward

A federal appeals court refused to dismiss assault charges against Rep. LaMonica McIver, D-N.J., ruling that physically striking ICE officers at a Newark detention facility has nothing to do with a congresswoman's legislative duties.
The U.S. Court of Appeals for the Third Circuit handed down a 2-1 decision keeping alive two of three federal counts against McIver, who faces charges of assaulting and impeding federal immigration officers during a chaotic May 2025 confrontation at the Delaney Hall ICE detention center in Newark, New Jersey. A third count was sent back to the lower court for further review. McIver had argued she was shielded by legislative immunity, that her actions at the facility amounted to congressional oversight. Two of the three judges on the panel flatly rejected that claim.
The ruling marks a significant setback for McIver and for the broader Democratic effort to frame physical interference with ICE operations as protected political speech. Court documents describe McIver allegedly slamming her forearm into a federal officer who was trying to arrest Newark Mayor Ras Baraka, and then using both forearms to strike another officer as she pushed back inside the secured area of the facility. Those are the acts of a person obstructing law enforcement, not conducting a committee hearing.
Biden-appointed judge sided with the government
The majority opinion came from an unlikely pair: Judge Stephanos Bibas, a Trump appointee, and Judge Cindy Chung, appointed by President Biden. Both agreed that McIver's conduct fell outside any constitutional protection for legislators. Fox News reported the majority wrote plainly:
"Like the acts charged in Count One, the acts of pushing past and forcibly striking someone are unambiguously non-legislative: they are not integral to the legislative process."
That a Biden-appointed judge joined this opinion undercuts McIver's narrative that the prosecution is a partisan vendetta. The court also agreed with the lower court's finding that McIver's "alleged intervention into the Mayor's questionable arrest had no cognizable connection to any legislative function" protected by the Constitution.
Judge Thomas Ambro dissented. He argued that blocking a member of Congress from entering a Department of Homeland Security facility amounted to denying her oversight authority.
"When an Executive Branch official prevents a Member from entering a [DHS facility], she is denied effective access to an oversight inspection."
But the majority was unpersuaded. Entering a facility to inspect conditions is one thing. Slamming your forearm into a federal officer is another. The court drew that line clearly.
McIver calls the ruling an attack on accountability
McIver wasted no time framing the decision as political persecution. She said "the court got it wrong" and issued a longer statement casting herself as a defender of vulnerable communities against an overreaching administration.
"Today's decision chills that authority and emboldens the Trump administration to continue persecuting our most vulnerable communities, those who try to defend them, and anyone who dares hold the president or his lackeys accountable. I will not fold to this administration. We are exploring every possible option. The administration will not stop me from doing my job or standing for what is right. This is not over."
Her congressional office called the charges "vindictive", a characterization, not a legal finding. McIver indicated she is weighing further legal options, though she did not specify whether that means seeking a rehearing before the full Third Circuit or petitioning the Supreme Court.
The statement reveals a familiar playbook: when caught, claim you were just doing your job. But two federal judges, including one appointed by a Democratic president, looked at the evidence and concluded that forearm-striking a law enforcement officer is not part of the job description for any member of Congress.
May 2025 standoff at Delaney Hall spiraled fast
The charges stem from a May 2025 incident in which a group of Democratic officials made an unannounced visit to the Delaney Hall ICE detention center in Newark. The visit devolved into a physical standoff between federal lawmakers and ICE agents. Newark Mayor Ras Baraka was arrested at the scene. McIver allegedly struck officers during the confrontation surrounding Baraka's arrest.
Three federal counts followed, all related to assaulting and impeding federal officers. The appellate court upheld two of those counts and sent the third back to the trial court for additional review. The specifics of that third count, and the legal standard the lower court must apply, were not detailed in the ruling as reported.
What happened to Baraka's arrest remains an open question. Whether charges against the Newark mayor were pursued or dropped is not addressed in the available reporting. But the broader picture is clear enough: elected Democrats showed up unannounced at a federal immigration facility, the situation turned physical, and now one of them faces a federal criminal case that a bipartisan appellate panel has allowed to proceed.
Third Circuit has been active on Trump administration clashes
The Third Circuit, which covers New Jersey, Pennsylvania, and Delaware, has been a busy venue for disputes between the Trump administration and its critics. The same court recently unanimously ruled that former Trump lawyer Alina Habba was unlawfully serving as Acting U.S. Attorney for New Jersey, finding the administration violated the Federal Vacancies Reform Act. Senior U.S. Circuit Judge D. Michael Fisher wrote in that case that "it is apparent that the current administration has been frustrated by some of the legal and political barriers to getting its appointees in place."
The Habba dispute involved a protracted legal battle over whether her 120-day interim appointment had expired, with federal judges in New Jersey at one point replacing her with a career prosecutor, only for Attorney General Pam Bondi to fire that prosecutor and reinstate Habba. U.S. District Judge Matthew Brann described the administration's moves as a "novel series of legal and personnel moves."
The McIver ruling cuts in a different direction. In the Habba case, the Third Circuit checked the administration's appointment authority. In McIver's case, the same court backed the administration's prosecution of a sitting congresswoman. The common thread is a judiciary willing to apply the law regardless of which side it inconveniences, a fact that weakens McIver's claim that the case against her is purely political.
Legislative immunity has limits the court made plain
McIver's core defense rested on the Speech or Debate Clause of the Constitution, which protects members of Congress from being questioned about their legislative acts. It is a real and important protection, designed to prevent the executive branch from intimidating lawmakers who cast inconvenient votes or hold uncomfortable hearings.
But the clause has never been understood to cover physical confrontations with law enforcement. The majority opinion drew that boundary with precision: pushing past officers and striking them are "unambiguously non-legislative." Congressional oversight involves subpoenas, hearings, document requests, and facility inspections conducted through proper channels. It does not involve forearms.
McIver's selective-prosecution argument fared no better at the appellate level for the two counts the court addressed directly. Her office's use of the word "vindictive" is a legal term of art, it implies the government brought charges to punish her for exercising a constitutional right. But the court's bipartisan majority found no basis to dismiss on those grounds for the counts before it.
The third count, sent back to the lower court, may still give McIver a partial opening. The specifics of what the trial court must reconsider were not laid out in the reporting. But two of three charges survived appellate review, and the case will proceed.
McIver says she will not fold. The federal court system, apparently, will not fold either. And the question now is straightforward: did a sitting member of Congress assault federal officers, or didn't she? A jury, not a press release, will answer that.

A Famous Forager
Harriet Tubman, a woman we would label “illiterate,” knew which plants would feed her passengers and which plants would heal her soldiers of dysentery, clean their wounds, and treat infections. Although most Americans know her only as a conductor on the Underground Railroad, she was so much more than that. She was a total badass.
She was an excellent Underground Railroad conductor, in part because she knew the plants along her escape route and what they were for. She used specific plants to keep babies asleep, others to keep dogs from following scents, and still others to keep her charges nourished along the long, slow journey to freedom.
In addition to what she is most famous for—serving as a conductor on the Underground Railroad—she was also the first woman to lead an armed military operation in the United States. This operation was the Combahee Ferry Raid, in which she freed hundreds of enslaved people. Part of the reason the army chose her for this role was her expertise in foraging for food and herbal medicine.
