Eagles always build their nests in high places, called aeries. The main reason they do so is for perspective. With a broad scope of the landscape below, they are able to protect their young, hunt for food and warn other eagles with distinct alarm calls.

One goal of this weekly dispatch is to do these same things. Looking back, we not only see what has happened, but also what is developing. We can ask, “What are the trajectories of these events? What do they portend? How can we protect our family of faith? Do we need to warn them?” That’s why…

It is not “old news.” It is looking at events from the perspective of an eagle in its nest, from a watchman in his tower.

This week, for example, we can see the activities of Iran’s arch-enemy, the government of Iran – the government, not its people.

While Iran’s imams are rebuilding their arsenal of missiles, including chemical and biological warheads for those missiles, the people of Iran are in the midst of a week-long protest against their leaders. The Islamist government might collapse. Pray that it does. On the other hand, a cornered carnivore is very, very dangerous.

If in the coming year, Iran is neutralized, there is another carnivore ready to pounce. That carnivore is a member of NATO: Türkiye. Bridging the West and the East, it draws on both in its explicit desire to re-establish the Ottoman Empire, even a global caliphate – a world government.

And it has its eye fixed on Jerusalem. One year ago, on 1 January 2025, there was a rally in Istanbul. This was its promotional poster…

The Lord is Wonderful

There is a Hebrew word that is only used in reference to the Lord.  The word is pele (Strong’s H6382).  Pele is found thirteen times in the Old Testament, and on each occasion, it refers to God Almighty.

“Who is like unto thee, O LORD, among the gods? who is like thee, glorious in holiness, fearful in praises, doing wonders?” – Exodus 15:11

“I will remember the works of the LORD: surely I will remember thy wonders of old.”

– Psalm 77:11

“Thou art the God that doest wonders: thou hast declared thy strength among the people.” – Psalm 77:14

“Marvellous things (wonders) did he in the sight of their fathers, in the land of Egypt, in the field of Zoan.” – Psalm 78:12

“Wilt thou shew wonders to the dead? shall the dead arise and praise thee? Selah.”

– Psalm 88:10

“Shall thy wonders be known in the dark? and thy righteousness in the land of forgetfulness?” – Psalm 88:12

“And the heavens shall praise thy wonders, O LORD: thy faithfulness also in the congregation of the saints.” – Psalm 89:5

Although the following verse does not seem to speak of the Lord, it refers to the result of an action of His: the withdrawal of His favour.  It laments the fall of Zion, or Jerusalem, and the result of the Lord withdrawing His favour from that city. 

“Her filthiness is in her skirts; she remembereth not her last end (considered not her destiny); therefore she came down (fell) wonderfully: she had no comforter. O LORD, behold my affliction: for the enemy hath magnified himself.” – Lamentations 1:9

There is one further verse which includes this apparently special Hebrew word, pele.  This verse is a clear prophecy of the coming Messiah and His supernatural nature.  The rabbis should have seen this indication, but they were blinded by the Lord (Deuteronomy 29:4, Isaiah 29:10).  The verse is Isaiah 9:6, which is frequently repeated during the Christmas season.

“For unto us a child is born, unto us a son is given: and the government shall be upon his shoulder: and his name shall be called Wonderful, Counsellor, The mighty God, The everlasting Father, The Prince of Peace.”

Praise the Lord for His wonderful gift of Jesus, and for the blessed eyes to see the wonderful promises throughout His Holy Word.  The Lord deserves all honour and praise!

For all the challenges facing Canada in the present, young conservatives continue to provide real hope for the future: they’re polling in strong numbers, campus conservative efforts are growing across the country, and they’re not settling for another decade of managed decline.

For all that they’ve been denied of late, be it a lack of housing, healthcare, jobs, or upward social mobility, they’re Canada’s ace in the hole to fix Canada’s problem of status quo-ism and failing gerontocracy. And Marland also believes they have a major role to play in reforming a conservative cultural vision.

Trump accuses Newsom, Walz of allowing fraud to run wild in states

President Donald Trump has unleashed a firestorm of criticism, targeting the governors of California and Minnesota with accusations of rampant fraud in their states, as Fox News reports.

Trump’s pointed remarks, made on Wednesday, claimed widespread misconduct in both states, specifically highlighting alleged election irregularities and child care scams, while triggering sharp responses from state officials and federal actions.

Starting with a bold social media post, Trump didn’t hold back, branding Govs. Gavin Newsom of California and Tim Walz of Minnesota as "Crooked" and accusing their states of being neck-and-neck in fraudulent activities.

Trump’s Sharp Critique of State Leadership

His statement, "There is more FRAUD in California than there is in Minnesota, if that is even possible," set the tone for a heated exchange.

Not stopping there, Trump also took aim at Rep. Ilhan Omar of Minnesota, linking a significant portion of the state’s alleged fraud to immigration issues and raising questions about her personal life, though without substantiating evidence.

While Trump’s rhetoric stirred the pot, attempts to get a response from Omar’s office or Walz’s team by Fox News Digital went unanswered, leaving the initial rebuttal space eerily quiet.

Newsom and Walz Fire Back at Accusations

California’s response, however, was swift and scathing, with Newsom’s press office firing off a post on X calling Trump "a deranged, habitual liar whose relationship with reality ended years ago."

They didn’t stop at insults, boasting that Newsom has thwarted over $125 billion in fraudulent activities and cracked down on those exploiting taxpayers, painting Trump as soft on the very scam artists he critiques.

Walz also pushed back, using his official X account on Tuesday to argue that Trump’s approach is a calculated move to politicize fraud allegations and slash funding for vital Minnesota programs.

Federal Action Freezes Minnesota Payments

The controversy took a tangible turn on Tuesday when Jim O’Neill, Deputy Secretary of Health and Human Services and acting CDC director, announced a freeze on all child care payments to Minnesota pending a fraud investigation.

O’Neill pointed to serious claims that millions in taxpayer funds have been diverted to fraudulent daycare operations in the state over the past decade, prompting a nationwide tightening of payment oversight.

This federal response, including a new requirement for justifications and evidence before releasing funds, underscores the gravity of the allegations and adds fuel to Trump’s critique of state mismanagement.

Walz Accuses Trump of Political Gamesmanship

On Wednesday, Walz doubled down on his personal X account, accusing Trump of exploiting fraud concerns as a pretext to harm working Minnesotans while allegedly freeing fraudsters from jail.

Walz’s frustration is palpable as he contrasts Minnesota’s efforts to combat fraud with what he sees as Trump’s hypocrisy on the issue, framing it as a deliberate attack on state welfare programs.

While the back-and-forth between Trump, Newsom, and Walz continues to dominate headlines, the underlying issues of fraud—whether in child care systems or election processes—remain a critical concern for taxpayers who deserve transparency and accountability from all levels of government.

Brian Stover launches campaign to succeed Marjorie Taylor Greene

Brian Stover just threw his name into the ring to fill the big shoes left by Rep. Marjorie Taylor Greene (R) in Georgia’s 14th Congressional District with a sharp new ad that’s got everyone talking.

Stover, a former Paulding County Commissioner, officially announced his candidacy in mid-December and dropped his first campaign spot on Thursday, aiming to win over the heavily Republican northwest Georgia district with a message tied tightly to President Donald Trump’s agenda.

For hardworking taxpayers in this district, Stover’s focus on slashing federal spending and lowering the cost of living hits home—especially when grocery bills and utility costs keep climbing with no relief in sight. His pledge to tackle these financial burdens head-on could be a lifeline for families already stretched thin. From a conservative standpoint, it’s about time someone stood up to the unchecked waste in Washington.

Stover’s Bold Entrance into the Race

Stover’s entry into the race comes as Greene, a prominent conservative and Trump ally since taking office in 2021, prepares to step away from Congress early in 2026. Her departure has opened the door for a competitive special election, drawing candidates from both major parties and even an Independent contender.

In his 30-second advertisement, Stover brands himself as a no-nonsense businessman, not another career politician. He’s banking on that outsider appeal to resonate with voters tired of the same old D.C. playbook.

“Like President Trump, I’m a businessman, not a politician,” Stover declares in the ad. Well, that’s a refreshing line in a world where slick suits often drown out common sense—but let’s see if he can deliver on the grit he’s promising.

“I’ll bring our values to D.C. … and fight tooth and nail to bring costs down,” Stover vows in his ad. That’s a tall order when federal budgets balloon faster than a hot air balloon, but if he’s serious, it’s a fight worth watching.

Federal Judge mandates Lexington school to Protect Child from LGBTQ content:

A federal judge just issued a ruling in Lexington that’s got parents cheering and progressive educators squirming.

On Dec. 31, 2025, US District Court Judge F. Dennis Saylor granted a preliminary injunction to a father, identified as Alan L., compelling Estabrook Elementary School to shield his kindergarten son from materials involving same-sex relationships and parenting that clash with the father’s Christian beliefs.

For concerned parents, especially those in Lexington, this decision is a lifeline against what many see as an overreaching progressive agenda in public schools, potentially sparing them the legal burden of fighting for their religious rights in court. Taxpayers, meanwhile, could face the financial fallout if school districts rack up hefty legal fees contesting such rulings. This isn’t just about one child; it’s a warning shot that compliance costs and courtroom battles may hit local budgets hard if schools don’t adapt.

Judge Upholds Father’s Religious Freedom

Judge Saylor’s ruling hinges on protecting Alan L.’s First Amendment right to exercise his faith and guide his child’s upbringing without interference from school curricula. The injunction specifically targets ten books, including titles like “Families, Families, Families!” and “This Day in June,” which depict same-sex families or Pride events.

Some of these books, as the judge noted, include imagery that’s a lightning rod for controversy—think illustrations of same-sex couples kissing or men dressed as nuns, possibly referencing the group known as the Sisters of Perpetual Indulgence. It’s no wonder a devout Christian father felt compelled to act.

Alan L. didn’t hold back in explaining his stance, saying, “When the school taught that ‘if you love each other, then you are a family,’ my child received a message that contradicts what we teach at home about God's design for marriage and family.” Let’s unpack that: schools pushing these ideas risk sowing confusion in young minds, especially when parents are still laying the moral foundation at home.

Books Banned Under Court Order

The court’s order is crystal clear—Estabrook Elementary must keep the child away from the listed books until a jury decides the case, unless the school wins an appeal. Titles like “Prince and Knight” and “Stella Brings the Family” are off-limits for this student, most of which use drawings to show same-sex parents.

One book, “You Have a Voice,” even mixes imagery of Black rights protests with LGBTQ flags bearing slogans like “Love is Love.” While diversity in storytelling has its defenders, many conservative parents question whether kindergarten is the place for such charged symbolism.

Judge Saylor himself highlighted the content of “This Day in June,” stating, “This Day in June features various illustrations of large crowds at what appears to be a Pride parade, including people dressed in leather, same-sex couples kissing each other, and one or more men dressed as nuns.” With imagery like that, it’s hard to argue this isn’t a direct challenge to traditional values some families hold dear.

Legal Precedent Fuels Ruling

This ruling didn’t come out of nowhere—it’s backed by a Supreme Court decision from June 2025, where a 6-3 majority affirmed parents’ rights to shield their kids from school materials on religious grounds in a similar Maryland case. Judge Saylor leaned on that precedent, seeing clear parallels in Lexington.

While Alan L. also pushed to block so-called DEI concepts—like discussions of racial protests—from his son’s education, the injunction sticks strictly to LGBTQ-related content. That’s a partial win, but it leaves room for future battles over broader cultural teachings in schools.

Let’s be honest: this isn’t about denying anyone’s humanity—it’s about who gets to shape a child’s worldview at such a tender age. Many conservatives argue that parents, not bureaucrats, should hold that power.

Broader Implications for Schools

For now, the injunction stands, forcing Estabrook Elementary to navigate a tightrope of accommodating one family’s beliefs while managing a classroom. How do you even implement this without singling out a child or disrupting others? It’s a logistical headache that could become a blueprint for chaos if more parents follow suit.

Progressive educators might cry foul, claiming this stifles inclusive teaching, but conservatives counter that public schools aren’t Sunday schools for secular ideals either. The balance of rights here is tricky, but Judge Saylor’s ruling sends a message: parental faith isn’t a suggestion—it’s a constitutional shield.

As this case heads toward a jury, all eyes are on Lexington schools and whether they’ll appeal or adapt. One thing’s for sure—this debate over what kids see in class is far from over, and it’s a fight worth watching.

Judicial Watch President Tom Fitton Receives Presidential Reappointment

District of Columbia Commission on Judicial Disabilities and Tenure

I am pleased to announce that President Trump has reappointed me to the District of Columbia Commission on Judicial Disabilities and Tenure for a five-year term. He initially appointed me to the commission in 2020. I issued this statement about the reappointment:

Thank you, President Trump, for reappointing me to the District of Columbia Commission on Judicial Disabilities and Tenure. I am honoured and humbled by your confidence. This important responsibility is, of course, in addition to my duties as Judicial Watch president. I look forward to my continued work with my fellow commissioners to ‘maintain public confidence in an independent, impartial, fair, and qualified judiciary, and to enforce the high standards of conduct judges must adhere to both on and off the bench.’ Our nation’s capital needs the best possible courts, especially in light of the public safety concerns that have gained national attention.

The District of Columbia Commission on Judicial Disabilities and Tenure was established by Congress to review complaints of misconduct against judges of the District of Columbia courts. The commission’s authority includes reappointment evaluations (sent to the president) of associate judges and performance and fitness reviews of senior judges.

The commission has “the authority to remove a judge for willful misconduct in office, for willful and persistent failure to perform judicial duties, and for conduct prejudicial to the administration of justice, or which brings the judicial office into disrepute. The Commission also has the authority to retire a judge involuntarily if the Commission determines that the judge suffers from a mental or physical disability which is or is likely to become permanent and which prevents, or seriously interferes with, the proper performance of duties. In addition, the Commission may, under appropriate circumstances, censure or reprimand a judge publicly.”

Judicial Watch Sues HHS for Human Fetal Tissue Research Records

Americans have a right to know basic information about the taxpayer-funded abortion industrial complex. As long as the government continues to fund these gruesome projects, we will work to expose them.

We filed a Freedom of Information Act (FOIA) lawsuit against the U.S. Department of Health and Human Services (HHS) for records from the National Institutes of Health (NIH) related to a federally funded human fetal tissue research program at the University of Pittsburgh (Judicial Watch Inc. v. U.S. Department of Health and Human Services (No. 1:25-cv-04498)).

We sued in the U.S. District Court for the District of Columbia after the National Institutes of Health, a component of Health and Human Services, failed to comply with a May 30, 2025, FOIA request for:

All documents and communications of officials in the Office of Extramural Research concerning the Final Research Performance Progress Report (FRPPR) for the GUDMAP program at the University of Pittsburgh (Project Number U24-DK110791-01).

The National Institutes of Health’s Office of Extramural Research provides guidance to institutes in research and training programs conducted through extramural (grant, contract, cooperative agreement) programs.

The GenitoUrinary (reproductive and urinary) Development Molecular Anatomy Project (GUDMAP) is a research consortium that receives funding from the National Institutes of Health. The abstract for project number 1U24DK110791-01 is titled “University of Pittsburgh as the GUDMAP Tissue Hub and Collection Site.” The fiscal year 2016 grant for $600,000 supported the procurement, processing, and distribution of human fetal tissues. The abstract states in part:

The Health Sciences Tissue Bank (HSTB) at the University of Pittsburgh has been involved in human tissue procurement for over 18 years. HSTB has an established program for acquiring fetal tissues. The fetal tissue IRB has been in place since 2005. HSTB has the infrastructure for dissecting specimens and collecting different tissue types. In this calendar year, we have disbursed over 300 fresh samples collected from 77 cases.

The collections can be significantly ramped up as material could have been accrued from as many as 725 cases last year. We have preliminary data showing that we can isolate the human urogenital system (kidneys, ureters and bladders) from various developmental ages (6-24 weeks). We have produced publication-quality images of these genitourinary organs (including kidneys and bladder) and have also been able to isolate and expand cells from various genitourinary organs.

In August 2021, we and the Center for Medical Progress uncovered Health and Human Services records that revealed nearly $3 million in federal funds were spent on the University of Pittsburgh’s quest to become a “tissue hub” for human fetal tissue ranging from six to 42 weeks of gestation.

In July 2023, we filed two amicus curiae (friend of the court) briefs to the Supreme Court of the United States in support of The Center for Medical Progress (CMP) and its founder Daleiden, asking for review of the Ninth Circuit Court’s affirmation of a monetary award against CMP (Center for Medical Progress et al. v Planned Parent Hood et al. (22-1168)), the other asks for review of an injunction granted to the National Abortion Federation that prevents CMP from publishing more abortion-related videos (Center for Medical Progress et al. v National Abortion Federation (22-1135)). 

In April 2022, we obtained records revealing that the Associate Senior Vice Chancellor for Science Strategy and Planning in the Health Sciences at the University of Pittsburgh, Dr. Jeremy Berg, contacted then-Director of the National Institutes of Health (NIH), Francis Collins, requesting help to combat “efforts to undermine important science using fetal tissue.” Additionally, the records included a scientific report containing information about grafting human scalp and other tissues onto mice.

In September 2021, we uncovered records from the U.S. Food and Drug Administration (FDA) involving “humanized mice” research with human fetal heads, organs and tissue, including communications and contracts with human fetal tissue provider Advanced Bioscience Resources (ABR). Most of the records are communications and related attachments between Perrin Larton, a procurement manager for ABR, and research veterinary medical officer Dr. Kristina Howard of the Food and Drug Administration.

In April 2021, we obtained records from the Food and Drug Administration (FDA) showing the agency spent tens of thousands of taxpayer dollars to buy human fetal tissue from California-based Advanced Bioscience Resources (ABR). The tissue was used in creating “humanized mice” to test “biologic drug products.”

In March 2021, we sued the U.S. Department of Health and Human Services (HHS) on behalf of the Center for Medical Progress for grant applications related to the use of human fetal tissue (Center for Medical Progress v. U.S. Department of Health and Human Services (No. 1:21-cv-00642)).

In June 2020, we uncovered records showing the FDA, between 2012 and 2018, entered into eight contracts worth $96,370 with Advanced Bioscience Resources (ABR) to acquire “fresh and never frozen” tissue from 1st and 2nd trimester aborted fetuses for use in creating “humanized mice” for ongoing research.

In February 2020, we received records from the National Institutes of Health (NIH) showing that the agency paid thousands of dollars to a California-based firm to purchase organs from aborted human fetuses to create “humanized mice” for HIV research.

Justice Dept. Sued Planned Parenthood, Human Fetal Tissue Records

The sale of human fetal tissue is a grisly business at odds with the values of most Americans, and transparency is the minimum requirement.

We filed a Freedom of Information Act (FOIA) lawsuit against the U.S. Department of Justice for records of communications between senior officials and key members of the U.S. Senate Judiciary Committee concerning Planned Parenthood, abortion, and the transfer of human fetal tissue (Judicial Watch Inc. v. U.S. Department of Justice (No.1:25-cv-04497)).

We sued in the U.S. District Court for the District of Columbia after the Justice Department failed to respond to May 30, 2025, FOIA requests to both the Office of Legislative Affairs and the Office of the Attorney General for all communications from January 1, 2019, to December 31, 2020:

• ·        Between officials in the Office of Legislative Affairs and Sen. Chuck Grassley, Sen. Lindsey Graham, and/or the Senate Judiciary Committee concerning Planned Parenthood, abortion, and/or the transfer of human fetal tissue.

• ·        Between then-Attorney General Bill Barr and Sen. Chuck Grassley, Sen. Lindsey Graham, and/or any official on the Senate Judiciary Committee concerning Planned Parenthood, abortion, and/or the transfer of human fetal tissue.

In June 2019, the U.S. Senate Committee on the Judiciary issued a letter to Barr and FBI Director Christopher Wray, following up on Grassley’s 2016 referral of eight organizations for investigation and potential prosecution for the alleged sale of human fetal tissue and inquiring as to whether the FBI had taken any action on the criminal referrals. The FBI has never confirmed publicly whether it investigated Planned Parenthood, or if it did, what it found.

During a September 2019 hearing at the San Francisco Superior Court, David Daleiden of the Center for Medical Progress provided testimony regarding his release in 2015 of 11 undercover videos showing Planned Parenthood officials discussing — and in some instances displaying — the harvesting and sale of aborted fetal organs and tissue. A non-physician who performed surgical abortions for Planned Parenthood testified that she regularly provided fetal tissue from abortions and was aware of financial exchanges with StemExpress.

In April 2020, invoices confirmed Planned Parenthood charged StemExpress $55 per “usable” organ — not simply for transport fees, as Planned Parenthood had previously claimed.

Among the many wasteful foreign aid programs the Trump administration eliminated from the U.S. government’s generously funded global health strategy is a $10 million venture to provide an African nation with toilets after a smaller American-funded effort to help villagers in the country build toilets with local materials failed. The multi-million-dollar remedy, part of Obama’s mission to end extreme poverty, focused on sanitation by installing special toilets, known as MVP1, in the East African island of Madagascar.

Over the weekend, a mainstream newspaper published a lengthy hit piece chastising the Trump administration for eliminating the costly African toilet endeavour funded by the United States Agency for International Development (USAID), the bloated State Department offshoot that annually disbursed tens of billions of dollars with little oversight or accountability before the president dismantled it. Now, “only the rich can afford a toilet,” in Madagascar, the recently published newspaper story declares as if that should be a concern for American taxpayers.

It marks the latest of extensive mainstream media coverage criticizing Trump’s razing of USAID—and questionable programs like the African toilets it bankrolled—while conveniently failing to report the pervasive fraud, waste and corruption that long gripped the foreign aid agency. Judicial Watch has exposed the crisis for years, reporting on a multitude of reckless USAID projects, including Kamala Harris’ failed multi-billion-dollar effort to curb “irregular migration” from three targeted countries known as the northern triangle—El Salvador, Guatemala, and Honduras—and millions of dollars to promote leftwing billionaire George Soros’ radical globalist agenda in Latin America as well as a fruitless Clinton-backed port and power plant in Haiti.

Judicial Watch has also taken legal action to uncover details about some of the agency’s problematic secret operations. In 2024, we sued USAID for records involving $27 million in Gaza grants that went to “Miscellaneous Foreign Awardees.” The Biden administration claimed the recipients could not be disclosed because the agency’s workers could be put at risk by Israel. Earlier this year, Judicial Watch filed a Freedom of Information Act (FOIA) lawsuit against USAID for failing to provide records about fraud and abuse tied to American aid money sent to Ukraine.

The multi-million-dollar African toilet project is just a shred of the broader problem, but worth noting because it provides the famously leftist establishment media with material to continue trashing the administration for redirecting its priorities involving global health strategies. Rather than dubious costly projects like toilets, the new focus is on preventing infectious disease outbreaks from reaching American shores, saving lives and preventing babies from being born with HIV/AIDS rather than sanitation in third-world countries.

“Our global health programs have become inefficient and wasteful,” the State Department’s latest America First Global Health Strategy reveals. The 40-page document outlines a comprehensive vision that requires co-investment from recipient governments and a path to decreased dependency on assistance from Uncle Sam, though other donor nations, such as Germany, Britain, Sweden and France, have followed the U.S. lead in drastically reducing foreign aid.

The recent newspaper article criticizes the Trump administration for failing to mention sanitation in its new global health strategy because it excludes projects like the African toilet venture. “Madagascar’s government, recently toppled in a military coup, has a punishingly long list of problems to deal with and spends just a tiny fraction of its budget on sanitation,” the news story states, adding that “studies have shown widespread contamination of Madagascar’s drinking water, the result of feces buried in pits seeping into the ground.”

The article does acknowledge that USAID paid $100,000 to clean up waste in Madagascar before cutting the MVP1 program, though part of the money was used to offer residents a free upgrade to an MVP2 toilet. The U.S. will continue helping impoverished African nations, the State Department assures, but the focus of the multi-billion-dollar funding will be on combating malaria and maternal-child health as well as global health security. The administration will give Madagascar more than $134 million in assistance under a bilateral global health agreement announced last week. The deal also includes over a billion dollars for Ethiopia, $106 million for Botswana and $30 million for Sierra Leone.

A significant Constitutional signal has emerged from the U.S. Supreme Court. In reviewing recent disputes over federal authority and domestic security deployments, the Court has effectively clarified that if a president wishes to deploy federal troops into states or cities facing severe breakdowns of law and order, the proper legal pathway is the Insurrection Act.

This clarification places the decision squarely within presidential authority. The Insurrection Act of 1807, signed by Thomas Jefferson, allows the president to deploy the U.S. military or federalize National Guard forces in cases of rebellion, insurrection, or when state authorities are unable or unwilling to enforce federal law or protect constitutional rights. The Act includes statutes and amendments passed between 1792 and 1871 and has been upheld repeatedly by the courts.

Importantly, the Insurrection Act can override the Posse Comitatus Act, which generally restricts military involvement in domestic law enforcement. The law gives the president broad discretion to determine when conditions such as “insurrection,” “domestic violence,” or “unlawful obstruction” exist. These terms are intentionally broad, a point affirmed by the Supreme Court as early as Martin v. Mott in 1827.

Recent court rulings indicate that if federal intervention is blocked through ordinary legal channels, the president retains the option to invoke the Insurrection Act to act unilaterally. In dissenting commentary, Justice Brett Kavanaugh warned that such rulings could result in greater use of federal military forces rather than state-controlled National Guard units, highlighting the seriousness of the constitutional threshold involved.

Speaking previously to reporters, Donald Trump stated that the authority to invoke the Act is well established and does not require further judicial approval if conditions warrant it. He emphasized that such measures are viewed as a last resort, pursued only after other legal avenues are exhausted.

Vice President JD Vance has also acknowledged publicly that all options remain under consideration, while legal analysts note that recent developments suggest the administration has been laying the legal groundwork should invocation become necessary.
