Police Fines:

Fines for violation of Covid-19 orders have been issued for almost a year now, without being judged in a court of law where they could be dismissed or mitigated. This is what a local police officer told us. The fines or tickets don't seem to be worth the paper they're printed on. You could ignore them until you get a subpoena to appear in court, if ever, and then you'd have the right to subpoena the chief medical officer and police officer to appear with the evidence against you, and the right of discovery to see their evidence in advance. (It's not necessary for you to provide discovery - your best evidence would be a video of what took place.)

Note: When anyone has made a court appearance without receiving a subpoena, they were surprised to find no prosecution witnesses, no "arresting" officer, and no record of any charges being made.

Police don't like the paperwork when they know it won't stand up in court anyway. The charges are illegal according to Canada's Charter of Rights and Freedoms. Politicians have been instructing lawyers to postpone or let the charges drop. The police only issue the charges when a Mayor leans on the Police Chief and insists that more charges be made.

Special "by-law officers" have been employed to write tickets. Unfortunately, many people pay the fines out of fear and ignorance. This includes store owners who are afraid of losing their licenses which is a different matter I'm not familiar with. [Patrick Bestall]
